In a bold move, his attorneys have requested a change of venue from Latah County to Ada County, citing a pervasive “mob mentality” that they claim has infected the local community.

The defense argues that intense media coverage and strong public opinion in Latah County have compromised Kohberger’s chances of receiving an impartial trial. They contend that the emotional impact of the crimes on the local community has created an atmosphere where finding unbiased jurors would be nearly impossible.

To support their case for a venue change, Kohberger’s team has submitted survey results and expert opinions, including an analysis by a social psychologist. “The mob mentality within the community is the exact reason that statutory grounds, prior to selecting the jury, exist to move (the) venue,” Attorney Elsa Massoth argued in a document filed with the Latah County District Court.

The defense team has highlighted concerns about the potential for violent reactions from Latah County residents if Kohberger is not convicted, contrasting this with less emotional responses from potential jurors in Ada County.

Prosecution Pushes Back

Latah County Prosecuting Attorney Bill Thompson has countered the defense’s arguments, stating that the request for a venue change is premature and lacks sufficient basis. The prosecution contends that media coverage of the case is widespread across Idaho, including in Ada County, and suggests that selecting jurors from neighboring Nez Perce County could be a more cost-effective alternative if a change is deemed necessary.

“For example, was there inflammatory or inaccurate news; were prospective jurors exposed to selectively packaged stories; and have prospective jurors been subtly conditioned to accept a certain version of facts at trial. If so, the constitutional balance would swing in favor of assuring a fair trial in another venue,” Attorney Colleen Kerwick said, highlighting the key considerations in the venue change request.

The prosecution also argues that keeping the trial in Moscow would be more convenient for witnesses and the victims’ families, a factor that could weigh heavily in the judge’s decision.

Looking Ahead

As the legal teams prepare for a hearing on the venue change request before Judge John Judge, the eyes of the nation remain fixed on this case. Kohberger, a former criminology graduate student at Washington State University, faces four counts of murder and one count of burglary for the November 2022 killings of University of Idaho students Ethan Chapin, Kaylee Goncalves, Xana Kernodle, and Madison Mogen.

With prosecutors seeking the death penalty if Kohberger is convicted, the stakes could not be higher. The trial, currently scheduled to begin on June 2, 2025, is expected to last through August, regardless of its location.
